Dear JDVause, Here is the long and the short of what you are eligible for, what the VA will give you , and what will never happen. First , an answer to your questions. If you are at all familiar with the Hepatitis C virus, you will know there are several subtypes or genotypes. I don't keep up on the listing but 1a, 1b, 2a, 2b, 3a,and 3b are the big ones. there is a new 7 from what I hear. Evidence from years of Vets applying for SC shows a large number of 1b and 3a cases from Vets stationed in Southeast Asia. That is not to say these were the only genotypes, just the most prevalent types. The second comment is a reference to what is unarguably the most common rating system for Hep. C. Stage is a term for the degree of damage to the liver, and Grade is a reference to how aggressively it is attacking the liver. If a Vet has a rather advanced case(i.e. 30+ years) it will be demonstrated by a liver biopsy of Stage 3 or 4. If it is actively munching the liver box it is Grade 3-4. If it is only moderately chewing on the liver , it might be categorized as Grade 1-2. During a course of Interferon/Ribavirin, it wouldn't be uncommon to see S3G1. If you clear the virus late in life, you might just end up with a Stage rating without a Grade rating. If you can get a nexus from a doctor saying that the hep is 30+ years old based on the biopsy info(STAGE),that would be a "supporting nexus". Now for what I would characterize as the distasteful part of this post. Your husband passed away without being awarded SC for the hep. It is difficult to win under these circumstances, not impossible. I don't know why there is such a negative atmosphere surrounding hepatitis. Your husband served 3 tours in SEA. I would have expected him to come down with it. Three years in that environment without being infected would be the miracle. You did not mention an autopsy. That would be conclusive evidence but the medical examiner's statement is acceptable. You will need to find the doctor that performed that autopsy (if they did) and ask him for a medical nexus to a risk factor mentioned in the 2004 claim and to rule out any brief episodes of drug abuse as a cause for the disease. If you can accomplish this, you will get an SC rating. You may have to appeal it to the Board of Veterans Appeals to win, but with a nexus from the M.E., service connection is attainable. I assume you were married more than 10 years. That is a requirement. I further assume your husband was honorably discharged. that, too , is a requirement. I hope your VSO is well-versed in DIC. There may be other obscure Catch 22s they have not discussed with you. I hope this is some help to you. I'm sorry to hear of your loss. It seems to be happening more and more frequently as we are all reaching the later Stages of this. I, for one,am S3G3.
