Okay. Here's the drill. You served during a time of war, regardless of whether you had any combat tours. Therefore you are eligible for a pension from the VA. This will not be in addition to to SSA. You get one or the other. You don't have to have any qualifying amount like SSA to get in . If your service was honorable and you got a DD 256, and you never had any negative events such as incidents involving willful misconduct, you may succeed in getting a pension. Especially if you show you are indigent, or on the way to being so. If your post service is spotless, devoid of a history of bank robbing, etc. , you stand a good chance of qualifying. Nothing ventured, nothing gained. With that said, I think you glossed over the most important part to get to the pension question. You say you filed for injuries incurred during groundpounding in the Army and were denied. Notwithstanding the fact that you have a DAV rep, I don't believe he has exhausted all the tools at his disposal to aid you. Do you believe your HCV is service connected? Has the rep said it's foolish to file for the hep? If you have a documented history of risk factors in service that would lead to Hep, then you need to file. We here at the HCVets site can guide you to a well -produced and prepared claim. My theory is that a pension would be my last resort. If you get SC for hep, that is compensation. You are still eligible for SSD/SSA in addition to the comp. Might be time to quit cutting bait and start fishing The VA pension is exactly equal to the VA compensation. 100% disability is $2527/mo. There are other categories of payments as needed for extensive medical situations. If you would like to pursue these avenues, perhaps you'll have to go outside the DAV box you're in and check out the comp. possibilities. I don't quite understand why you lost on your first go around that would aim you towards the pension .Tell us more,we'll brew up some tea, and read your leaves.
