Phase VII------------------------------------Your first denial This may have already happened to you. If it did, and you didn't appeal, you need to go back to Phase 1 and start reading. You will be filing a NOD which must be accomplished within one(1) year of the date stamped on the front of your rating. That's 365 days-exactly if you are mathmatically challenged. Failure to do so is dumb. I speak with much authority here as I am one of the dumb. I relied on a VSO group known to all as AMVETS. For some unknown reason my SO took my appeal with him to his new job as a car salesman and didn't tell me. After a loooong time I finally called up and discovered the problem. Too long. If you choose to use a VSO, and I see no reason not to, please supervise your rep. I am constantly amazed at what they don't know, or worse, what they mistakenly believe to be true. Now, You've filed the NOD. You may ask that a DRO review the decision for correctness or take the traditional route to appeal. In that case, the RO will analyze it again, and, if you haven't added anything(A New Nexus or better), you will be overjoyed to discover the mailman has delivered your SOC. Remember, I told you those binoculars would come in handy. At this point, it will behoove you to at least think about that extra or beefier nexus and submit it with your Form 9. If you are doing this Pro Se, that will involve your using a standard 8 1/2 x 11 blank paper in which you state that you wish to appeal this to the BVA in DC and that you wish the VA to consider the letter as a Form 9. Soon, in the distance,(thanks to those binoculars) you will discern the mailperson coming with the SSOC. You will again be free to submit more evidence and then "the big wait" for the BVA decision begins. Mailbox fever sets in and there is no known cure for it. Your wife will accuse you of having an affair with the mail lady. Life, as you know it, will slow to a crawl. Weeks will turn into months followed by years. If you are extremely lucky, and the RO didn't somehow screw up 2 years back, you may be greeted with a BVA rating in your favor. If, God Forbid, the RO did make a mistake in adjudicating this, then it is REMANDED to the AMC. They, in turn, hand off to the Pony express guy who climbs on the anemic horse and heads back to your local RO at a glacial pace. By this time you have hocked the binocs. You're broke, dude. Wife's left. One day you go to the mailbox and there it is! Your denial/grant. If you are denied, you now have 120 days to file the NOA with the CAVC in DC.Not one minute more. At this point, you better know how to count to 120 sunrises and sunsets, because these gentlemen are way past serious.They've already heard the one about how the dog got Parvo and died or how the raccoons in the garbage can kept you up all night and you became an insomniac. Won't work. They purchased the same excuse book you're plagarizing from.
